Freight transportation is vital to the U.S. economy and the daily needs of Americans throughout the country. Households and businesses depend on the efficient and reliable delivery of freight to both urban and rural areas. Federal support for freight increased under the Fixing America’s Surface Transportation (FAST) Act, as the FAST Act included provisions to define, establish, and provide funding for a national highway freight program. The FAST Act freight provisions were designed to address significant needs in the transportation system to ensure that projected increases in freight volumes can be handled efficiently across all transportation modes.

A lockbox containing $1.5 billion in federal funding for surface transportation projects has just opened up to communities across the United States. The funding comes from a new program called the Better Utilizing Investments to Leverage Development (BUILD) grant program. The announcement came this week from the U.S. Department of Transportation (USDOT). Any federal program that provides funding for transportation projects is great news to state and local officials. However, the same type of funding was previously available – just under another name. The new BUILD program is what the Trump administration calls an “enhanced” version of the former very popular TIGER (Transportation Investment Generating Economic Recovery) grant program. Translated, that means this is not really new funding.

MAP-21 (Pub. L. 112-141 (2012)) amended Federal transit law by authorizing a new Public Transportation Safety Program at 49 U.S.C. § 5329. Pursuant to Section 5329(b), the Public Transportation Safety Program must include a National Public Transportation Safety Plan to improve the safety of all public transportation systems that receive Federal transit funds.

Last week, DOT announced another groundbreaking financial tool – a product of the Build America Bureau – and provided an example. The Central Puget Sound Regional Transit Authority (Sound Transit) and the Build America Bureau signed a pioneering, first-of-its-kind Master Credit Agreement (MCA). The agreement lays a foundation for working together to initiate four transit projects in the Seattle area. The projects, now that they are consolidated, will be eligible to receive close to $2 billion in financing. As a result of the MCA, the Build America Bureau will be able to close one deal that covers multiple projects.

The U.S. Department of Transportation (DOT) plays a critical role in connecting Americans and communities to these opportunities. DOT’s role has typically been to directly support the states through drafting regulation, creating informational resources, and providing technical assistance and program funding. Through the Ladders of Opportunity Transportation Empowerment Pilot (LaddersTEP) model, DOT provided direct aid to cities to achieve these positive results.
